Standard Terms and Conditions of Rental

Your acceptance of equipment from Eco-Rental Solutions LLC by shipper, courier, supplier or Eco-Rental Solutions employee constitutes acceptance of this contract and the Terms and Conditions as listed.

Eco-Rental Solutions LLC will provide client with rental equipment in good working condition.

Customer is responsible for returning the equipment in substantially the same condition as when received from Eco- Rental Solutions LLC, ordinary wear and tear excluded. Customer agrees to compensate Eco-Rental Solutions LLC for any damages caused by customer. Customer is responsible for loss or damage to equipment from theft, mysterious disappearance, fire or any other cause. In accepting liability for the safe keeping of all rented equipment, customer agrees to pay Eco-Rental Solutions LLC the replacement cost (as determined by manufacturer’s current list price) of any such equipment which customer is for any reason unable to return to Eco-Rental Solutions LLC at the end of the rental period.

It is the customer’s responsibility to fully decontaminate and clean equipment prior to return to Eco-rental Solutions. Equipment which is returned in an unclean condition is subject to return to customer without termination of rental period, or may result in a decontamination fee. Customer must notify Eco-Rental Solutions of the specific nature of any substance present on the returned equipment.

The rental period starts on the day that the customer receives the equipment, unless it is received after 12:00 pm customer’s local time, or on a weekend, in which case the rental period starts the following business day. Saturday and Sunday are not rental days. A one-day minimum rental period will apply in any case. Equipment will be taken off rental on the day that it is received by Eco-Rental Solutions. The last billable day will be the business day prior to receipt if the equipment is dropped off before 12:00 pm, and the day of receipt if it is dropped off after 12:00 pm, unless other arrangements are agreed upon in writing. Federal Express and UPS return deliveries will be taken off rental the day
received with the last billable day being the previous business day.

Payment terms are 2% 10 days, net 30 from date of invoice. Customer is responsible for all taxes, duties, and fees associated with the rental contract. Customer acknowledges that unless otherwise specified shipping and handling is additional to and from Eco-Rental Solutions LLC.

Customer shall use rental equipment in a careful and proper manner in compliance with all laws and other governmental requirements and the manufacturer’s instructions and specifications and shall keep the equipment free from all liens and encumbrances. Except upon the prior written consent of Eco-Rental Solutions LLC customer shall not (1) assign or sublet the equipment or (2) allow any alterations, modifications or repairs of any equipment by anyone other than Eco-Rental Solutions LLC. Customer shall bear the entire risk of loss or damage to the equipment for any cause, and shall indemnify and hold Eco-Rental Solutions LLC harmless from any and all claims, liabilities, losses, costs and expenses (including attorney’s fees and court costs) arising out of the use, possession, operation or renting of the equipment.

In no event, whether as a result of breach of contract or warranty, tort (including negligence) or otherwise, shall Eco- Rental Solutions LLC be liable for any consequential, incidental or exemplary damages, including, without limitation, any loss of profit or revenues, loss of use of any equipment or any other equipment, damage to other equipment, cost of substitute equipment or downtime costs. Customer must be fully trained in the use of purchased or rented equipment. All liabilities related to the use of the equipment are the responsibility of the customer. Eco-Rental Solutions uses 3rd party hosted software and will send out all invoices by e-mail unless requested to do otherwise. Eco-Rental Solutions may also periodically provide technical bulletins, product updates, promotions and other related material through email.
